A layoff starts several clocks at once, and most of them start on the day you hear the news, well before your last day of work. In the first week, protect five things: your time to read the severance paper, your health cover, your claim for unemployment benefit, your right to contest the dismissal, and your written reference. The resume can wait until Friday.

Below is each clock, what it looks like in three countries, and the questions people ask next.

Why the first week matters more in 2026

The US added 162,000 jobs in August 2026 and unemployment was 4.1%, with the information sector down 23,000 jobs, according to the Bureau of Labor Statistics Employment Situation report published on September 4. The layoff news reached well past one country. Uber announced cuts of about 10% of its staff on September 2. Volkswagen's supervisory board approved 50,000 more job cuts on September 3. JLR announced 4,000 job cuts on September 7.

The number that matters most for your own plan is time. Half of the people unemployed in the US in August 2026 had been out of work for 11.4 weeks or longer. That median was 10.5 weeks in July and 9.9 weeks a year earlier (BLS table A-12). So whatever you secure in week one has to last.

The five clocks that start when you find out

  1. The severance paper. It usually trades money for claims you give up, and many legal systems give you time to consider it. Do not sign it in the meeting.
  2. Health cover. If your insurance came through your job, there is often a window to continue it. It closes whether you read the letter or not.
  3. Unemployment benefit. Registration usually has to happen fast, and payments are counted from the day you file or register.
  4. Contesting the dismissal. Many countries give you a short window to challenge a dismissal you think was unfair. In some it is weeks.
  5. Your written reference. The manager who can describe your work is still reachable this week.

Should I sign a severance agreement right away?

No. A severance agreement is a trade: money now for claims you give up. You cannot judge that trade in the room where it is handed to you.

In the US, the law puts a number on it for older workers. If you are 40 or older and the agreement asks you to waive age discrimination claims, your employer must give you at least 21 days to consider it, or 45 days if the offer is part of a group layoff program. You then get 7 days after signing to change your mind (29 USC 626(f)). If your country sets no minimum, ask for time in writing anyway.

Read the agreement for three things:

  • The money. How much, when it is paid, and what would stop the payments.
  • What you give up and what you promise. Which claims you waive, plus any confidentiality, non-disparagement or limit on where you work next.
  • Your benefits and reference. When health cover ends, what happens to bonus or equity already earned, and whether the company will give a reference.

In the UK, check the package against the legal floor. Employees with 2 years or more with the same employer are normally entitled to statutory redundancy pay (gov.uk).

How soon should I file for unemployment after a layoff?

As soon as you can, ideally in the first week.

The US Department of Labor tells people to contact their state unemployment agency as soon as possible after losing a job. Some states have a one-week waiting period before benefits start. The first payment usually arrives 2 to 3 weeks after you file, and most states pay for up to 26 weeks (US Department of Labor).

Germany is stricter and earlier. You must register as job-seeking with the Agentur für Arbeit within 3 days of learning that your job will end, or 3 months before the end date if you know that far ahead (§38 SGB III). Register late and you face a one-week Sperrzeit, a block on unemployment benefit (§159 SGB III). The German clock starts when you learn about the end, which can be months before your last day.

Put those rules next to the 11.4-week median and the math is plain. A typical search fits inside a 26-week benefit window, but only if the window opened on time.

How long do I have to keep my health insurance after a layoff?

If your cover came through your employer, find the continuation option and its deadline in the first week.

How long do I have to elect COBRA?

In the US, you have at least 60 days to elect COBRA continuation coverage. The 60 days count from the later of two dates: the day your coverage ends, or the day you get the election notice (29 USC 1165(a)(1)). Use that window to compare the cost against your other options, such as a partner's plan, before you commit.

Can I still challenge the dismissal?

Often, yes. The window is short, and it usually runs from the day you are told.

  • Germany: a claim against the dismissal, the Kündigungsschutzklage, must be filed within 3 weeks of receiving the written notice (§4 KSchG).
  • UK: you usually have to make an employment tribunal claim within 3 months of your employment ending. You will usually need an early conciliation certificate from Acas first (gov.uk).
  • US: covered employers with 100 or more workers must give 60 days of notice before a plant closing or mass layoff (29 USC 2102). If yours came with no warning, ask HR whether that rule applied.

You do not have to decide this week whether to fight. You do have to know your date, so that the choice stays yours.

Ask for your written reference before people leave

The person who can describe your work best is your manager, and this week they still work there. Ask now for a written reference, or at least for their agreement to be a reference and a way to reach them later.

In Germany this is a legal right. Employees are entitled to a written reference, the Arbeitszeugnis, when employment ends, and can ask for one that covers performance and conduct as well as dates (§109 GewO).

What happens to money tied to my job?

A layoff can put a deadline on money you already have. In the US, if you leave with a 401(k) loan and the plan offsets the unpaid balance, you can roll the offset amount into an IRA or another plan until your tax return due date for that year, including extensions (IRS). Miss that date and you lose the chance to roll it over.

In other countries, look for the same pattern: a pension, a loan from your employer, shares that have not vested, or a bonus that pays only if you are still employed on a certain date. Write down every date you find.

How long does it take to find a job after a layoff in 2026?

Plan for about three months, and budget for longer. Half of the people unemployed in the US in August 2026 had been out of work for 11.4 weeks or more, and that figure rose from July and from a year earlier (BLS table A-12).

  2. Day 1 to 3. Register for unemployment benefit, or as job-seeking if you are in Germany.
  3. Day 2. Save your own documents: payslips, benefit letters, your contract and personal contacts.
  4. Day 3. Write down every deadline on this page that applies to you, with its end date.
  5. Day 4 to 5. Ask for your reference, and decide whether to get advice while the windows are open.
