In-House Legal Associate (Real Estate Recovery & RERA Compliance) Location: Malad (East), Mumbai (On-site) Experience: 2 to 4 years (Post-Qualification Experience) Industry: Real Estate / Property Development Employment Type: Full-time About the Role We are an established real estate development firm in Mumbai actively executing residential and commercial projects. We are seeking a sharp, driven, and assertive In-House Legal Associate to join our team. The primary mandate for this role is to fast-track outstanding payment recoveries from defaulting buyers, enforce strict contractual compliance under MahaRERA, draft legal notices within quick turnarounds, and oversee sub-registrar and regulatory procedures. You will work closely with the leadership team and collaborate with our retainer Senior Legal Counsel on complex court/tribunal matters. Key Responsibilities 1. Default Tracking & Payment Recovery
Audit buyer milestone payments daily and calculate interest on delayed installments per MahaRERA norms (SBI Benchmark Lending Rate + 2%).
Draft and dispatch formal legal notices, default warnings, and allotment cancellation letters to defaulting buyers within 24–48 hours of escalation.
Handle firm, professional email correspondence and phone communications with buyers regarding overdue payments and contractual obligations.
Negotiate structured payment timelines or out-of-court settlements with defaulting buyers while protecting the firm’s legal standing.
2. MahaRERA & Regulatory Compliance
Ensure full compliance with Sections 13, 18, and 19 of the Real Estate (Regulation and Development) Act, 2016.
Draft, verify, and file complaints, replies, or applications before MahaRERA Authorities and the Sub-Registrar.
3. Documentation & Field Execution
Draft and review Agreements for Sale (AFS), Allotment Letters, Supplementary Deeds, Revocation Deeds, and Lease/Rental Agreements.
Visit local Sub-Registrar offices across Mumbai for document registrations, title search reports, and deed revocations.
Coordinate directly with external senior advocates, preparing brief notes, case files, and evidence for high-stakes litigation.
Key Performance Indicators (KPIs)
Notice Turnaround: Dispatching legal notices within 24–48 hours of payment milestone breach.
Recovery Success Rate: Measurable reduction in buyer payment default rates and collection of accrued delay interest.
Zero Regulatory Default: Maintaining 100% compliance on the MahaRERA portal without procedural delays.
Requirements & Qualifications
Education: Bachelor’s Degree in Law (LL.B.) from a recognized university.
Experience: 2–4 years of core experience in real estate litigation, payment recovery, and MahaRERA laws in Mumbai.
Bar Council: Active Bar Council Registration as an Advocate.
Languages: Fluent in English, Hindi, and Marathi (Marathi is essential for local sub-registrar office filings and local authority liaison).
Key Competencies: Strong notice drafting skills, firm negotiation capability, attention to detail, and a results-driven attitude.
